The Cambodian study was one of a series of international clinical trials sponsored by the U.S. National Institutes of Health, U.S. Centers for Disease Control and Prevention, and (...) the Bill and Melinda Gates Foundation testing the safety and efficacy of tenofovir, an antiretroviral drug produced by Gilead Sciences, Inc., to prevent HIV transmission. Must treatment be provided to subjects who acquire HIV during the course of a prevention study? An analysis of ethical foundation, regulation, and recent argumentation provides no basis for the obligation. We outline an alternative approach to the problem based on moral negotiation.

Issues: We present key aspects of our paper, commissioned by UNAIDS in 2005, entitled, “Revisiting the ethics of HIV prevention research in developing countries.” In 2004 and 2005 we witnessed the closure or suspension of three international clinical trials testing tenofovir in the prevention of HIV infection in high risk groups due to the failure to provide free treatment to those who seroconvert during the conduct of the study. We examine critically moral claims for the provision of treatment to those (...) who seroconvert in HIV prevention trials and ask whether it is a matter of moral obligation or moral negotiation?Description: Using the tools of philosophical and regulatory analysis we examine the moral foundations of research ethics, international regulation, and the contemporary literature in search of valid arguments in support of a moral obligation to treat. Arguments supporting the obligation to provide such treatment are found in a wide variety of documents. These claims are variously rooted in the demand to compensate for research-related injury, maximization of research benefit, justice as reciprocity, and justice as equality.Lessons learned: Our analysis reveals that there is as of yet no robust moral argument supporting a moral obligation to provide treatment to participants in HIV prevention trials who seroconvert. We argue that moral negotiation offers distinct advantages over moral obligation. Moral negotiation finds support in the principle of respect for communities that holds researchers responsible to respect communal values, protect and empower social institutions and abide by the decisions of accepted communal authorities.Recommendations: Moral negotiation, rather than moral obligation, reduces the chance of polarization of positions by inviting trial participants, sponsors, researchers and all other involved parties to the table for discussion. Moral negotiation favors middle ground solutions that fit the specific health needs and priorities of the community in question. (shrink)

Charles Péguy (1873–1914) was a French religious poet, philosophical essayist, publisher, social activist, Dreyfusard, and Catholic convert. There has recently been a renewed recognition of Péguy in France as a thinker of unique significance, a reconsideration inspired in large part by Gilles Deleuze’s Différence et répétition, which ranked him with Nietzsche and Kierkegaard. In the English-speaking world, however, access to Péguy has been hindered by a scarcity of translations of his work. This first complete translation of one of his (...) most important prose works, with accompanying interpretive introduction and notes, will introduce English-speaking readers to a new voice, which speaks in a powerful and original way to a modern West in a condition of cultural and spiritual crisis. The immediate circumstance of the writing of this last prose essay, unfinished at the time of Péguy’s early death, was the placing of Henri Bergson’s philosophical works on the Catholic Index, and Péguy’s undertaking to defend his former teacher from his critics, both Catholic and secular. But the subject of Bergson is also a springboard for the exploration of the perennial themes—philosophical, theological, and literary—most central to Péguy’s thought. (shrink)

Each chapter has a general introduction and ends with suggestions for further readings; and each of the texts is prefaced by a short explanatory paragraph. Overall, the book provides an historical introduction to central ethical themes of American thought.

Contemporary recognition of the importance of divisions amongst pragmatic and semantic phenomena has its roots in earlier recognition of the importance of pragmatic phenomena. This chapter begins with the idea that semantics concerns the stable meanings of words and expressions while pragmatics concerns language use, or things done with words. It provides some grounds for rejecting, a defense of orthodoxy that sought to treat the variations that Charles Travis highlights as occurring only with respect to derivative illocutionary acts. The (...) chapter argues that the orthodox view comes under pressure from reflection on certain forms of variation in the illocutionary acts that speakers perform. It explores how the meanings of the words that the speaker used, which figure most directly in the locutionary act that they performed, figure less directly in the illocutionary act or acts that they perform, and less directly still in the further, perlocutionary consequences of the performance of that illocutionary act. If Peirce was a "backwoodsman" of semiotic, Deledalle is a pioneer in presenting Peirce to francophone readers. His new book aims at introducing them to a global reading of Peirce's thought according to three periods:nominalistic (1851-70), logico-mathematical and methodological (1870-87), and metaphysical (1887-1914). Given Peirce's writing output, to synthesize, systematize and periodize his works would have been a colossal endeavor. However, Deledalle limited himself to the "Collected Papers" and to an already existing periodization. But the decision not to take into (...) account the available volumes of the chronological edition leads to certain distortions concerning the nature of semiotic. And the bibliography is rather sketchy. (shrink)

Ce livre propose d'aborder la pensée de Charles Taylor par ce qu'il reconnaît être son centre de cohérence : "l'horizon moral de signification". D'entrée de jeu, il situe assez clairement Taylor dans le vaste horizon de la philosophie morale contemporaine. Le texte pose bien l'originalité de la conception taylorienne de l'ontologie ; ses idées d'incarnations, d'engagement et la relation incontournable du moi. Sans complaisance, il montre le rôle central que joue cet horizon dans la philosophie morale taylorienne tout en (...) exposant les zones d'ombre où Taylor est moins clair ou moins explicite dans sa pensée. En illustrant clairement le lien entre l'horizon moral et l'identité d'une part, et celui entre les horizons et le dialogue interculturel d'autre part, le livre enrichit les analyses existantes sur le sujet. Il expose le dilemme taylorien entre contexte et universalisme. L'originalité de Taylor réside dans la manière dont il repose ce dilemme conservant en tension ces deux axes; orienter sa vie en fonction du bien nous oblige à naviguer entre deux eaux. La question du dialogue interculturel est naturellement incontournable dans le présent débat avec Taylor. Les considérations sur le "langage des contrastes" et le passage par les écrits de Raoul Fornet-Betancourt sont tout à fait pertinents. En effet, l'interculturalité ou le dialogue interculturel appelle un nouveau langage, mais les conditions de celui-ci? et son statut ontologique d'ailleurs ne sont pas clairement exprimées dans les écrits tayloriens. Et ils peuvent difficilement l'être, car cela demeure pour lui de l'ordre du mystère et du dévoilement. L'ouverture à l'autre et à l'altérité est un chemin qui mène à plusieurs inconnus et appelle ce que Taylor nomme une transformation."--Page 4 of cover. (shrink)

In this article, we argue that a critical examination of epistemological and anthropological presuppositions might lead to a more fruitful use of theory in clinical-ethical practice. We differentiate between two views of conceptualizing ethics, referring to Charles Taylors' two epistemological models: ‘monological’ versus ‘dialogical consciousness’. We show that the conception of ethics in the model of ‘dialogical consciousness’ is radically different from the classical understanding of ethics in the model of ‘monological consciousness’. To reach accountable moral judgments, ethics cannot (...) be conceptualized as an individual enterprise, but has to be seen as a practical endeavor embedded in social interactions within which moral understandings are being negotiated. This view has specific implications for the nature and the role of ethical theory. Theory is not created in the individual mind of the ethicist; the use of theory is part of a joint learning process and embedded in a cultural context and social history. Theory is based upon practice, and serves practical purposes. Thus, clinical ethics support is both practical and theoretical. (shrink)

Impressionnés par l'enseignement du Maître, certains de ses étudiants et même de ses collègues considéraient Charles Hauter comme un génie. Il enseigna à la Faculté protestante de l'université se Strasbourg de 1919 à 1961 et passa de la philosophie religieuse à la théologie dogmatique. Mais pendant cette longue période, ses publications sont relativement peu nombreuses. In today’s pluralistic society, clinical ethics consultation cannot count on a pre-given set of rules and principles to be applied to a specific situation, because such an approach would deny the existence of different and divergent backgrounds by imposing a dogmatic and transcultural morality. Clinical ethics support (CES) needs to overcome this lack of foundations and conjugate the respect for the difference at stake with the necessity to find shared and workable solutions for ethical issues encountered in clinical practice. We (...) argue that a pragmatist approach to CES, based on the philosophical theories of William James, John Dewey, and Charles Sanders Peirce, can help to achieve the goal of reaching practical solutions for moral problems in the context of today’s clinical environment, characterized by ethical pluralism. In this article, we outline a pragmatist theoretical framework for CES. Furthermore, we will show that moral case deliberation, making use of the dilemma method, can be regarded an example of a pragmatist approach to CES. (shrink)
